In early 2019, the United States Judicial Panel on Multidistrict Litigation transferred multiple related valsartan lawsuits from districts across the United States into one consolidated case in New Jersey. The panel renamed the case In re: Valsartan Products Liability Litigation, MDL No. 2875.
The principal common defendants in the multidistrict litigation (MDL) consolidated case are:
- Zhejiang Huahai Pharmaceutical Co., Ltd (ZHP)
- ZHP’s U.S. affiliates Prinston Pharmaceutical Inc., Solco Healthcare U.S., LLS, and Huahai U.S., Inc.
- Walgreen Co.
- Throggs Neck Pharmacy
The plaintiffs allege that:
- Impurities in drugs that contained valsartan presented a risk of cancer and liver damage
- The defendants knew or should have known about the tainted products as early as 2012
The MDL panel noted that the Food and Drug Administration (FDA) announced in late 2018 that they found the N-nitrosodimethylamine (NDMA) contamination from another overseas supplier in India. The panel stated that the MDL case could expand as the FDA unearths more information in its ongoing investigation.
The Problems with Valsartan
Valsartan is a substance in a class of drugs called angiotensin receptor blockers (ARBs). The drugmakers say that a third-party company that distributed valsartan to the pharmaceutical companies to use when making the medications sold them supplies of valsartan that had an impurity that is a probable human carcinogen.
The chemical that contaminated the valsartan supply is NDMA. After 22 countries in Europe issued recalls of the tainted drugs, the FDA in the United States took action. Not all batches of valsartan have the impurity.
The recalled valsartan-containing medications sold in the US are from these pharmaceutical companies:
- Teva Pharmaceuticals, which labeled its products as Major Pharmaceuticals
- Prinston Pharmaceutical Inc. (Solco Healthcare LLC)
- Teva Pharm. USA (Activis)
- AvKare (Teva/Activis)
- And many other formulations by additional drug makers
Medical experts urge people taking prescription medications for high blood pressure or heart failure to check with their physicians about whether they should switch to a different drug. Doctors warn people not to stop taking their medication without first consulting with their healthcare provider. There are quite a few drugs without valsartan that can treat these medical conditions.
Why NDMA Is Dangerous
Researchers found that NDMA can damage the liver and cause scarring, fibrosis, and tumors of the liver. They performed the studies on rats, which allowed the scientists to infer that the substance will harm humans. The EPA says that exposure to high levels of NDMA can cause liver damage in humans.
NDMA has many uses in industrial settings and manufacturing.
Trouble Ahead for Drug Manufacturers Who Made Medicines with Valsartan
After the initial recalls, the FDA warned that the ongoing investigation will likely reveal more contaminated medications. The FDA said that the Chinese manufacturer linked to the tainted valsartan changed the way it makes synthetic valsartan at some point after 2010. The 22 European countries and the FDA did not start recalls until July of 2018.
The FDA has found the NDMA in two additional prescription drug components, losartan. and irbesartan. The scale of the problem is significant. A total of 60 million patients in America bought medications containing at least one of these three chemicals in 2016. This number does not include those who received the drugs online, through a hospital, or the U.S. Department of Veterans Affairs (VA) system.
